Ice-Skating Mail Club Terms of Service

These Terms of Service (“Terms”) govern your purchase and use of the Ice-Skating Mail Club subscription, website, physical mailings, digital materials, and related products and services. The Ice-Skating Mail Club. By purchasing a subscription, accessing our materials, or using our website, you agree to these Terms. If you do not agree to these Terms, please do not purchase or use the Ice-Skating Mail Club.

1. Subscription Service

The Ice-Skating Mail Club is a monthly subscription designed to bring creativity, encouragement, and ice-skating fun to children through the mail.

Monthly packages may include:

A coloring page

A trading card

A color character picture

A character story

Character stickers

A color palette

The exact contents, characters, designs, themes, colors, materials, and quantities may vary each month. We reserve the right to update, replace, add, or remove materials as the Ice-Skating Mail Club develops.

2. Eligibility and Adult Purchases

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase a subscription. Subscriptions intended for children must be purchased and managed by a parent, legal guardian, or other responsible adult. By purchasing a subscription for a child, you confirm that you have the authority to provide the child’s name and mailing information and to allow the child to receive and use the materials. You agree to provide accurate and current billing, email, contact, recipient, and mailing information. You are responsible for updating this information before your next payment or mailing is processed. We are not responsible for packages that are delayed, returned, misdelivered, or lost because incorrect or outdated information was provided.

3. Automatic Monthly Renewal

The Ice-Skating Mail Club is an automatically renewing monthly subscription. Your selected payment method will be charged each month until you cancel. The subscription price, billing frequency, shipping charges, applicable taxes, and automatic-renewal terms will be presented before you complete your purchase. By subscribing, you authorize us and our payment processor to charge your selected payment method for each monthly renewal unless and until you cancel.

4. Cancellation Policy

You may cancel your subscription at any time using the cancellation method provided through your account or subscription-management portal. To avoid being billed for the following month’s package, you must cancel your subscription no later than 11:59 p.m. Pacific Time on the 30th of the current month. Cancellations received after the 30th will take effect after the following month’s payment and mailing have been processed. You will continue to receive any package for which payment has already been collected. Cancellation stops future renewals. It does not cancel or refund payments that have already been processed.

5. Refund Policy

All subscription payments and product purchases are final and nonrefundable, except where a refund is required by applicable law. Because monthly materials are designed, printed, prepared, and packaged in advance, we do not provide refunds, returns, exchanges, credits, or prorated refunds for:

A change of mind

Failure to use the materials

A child losing interest in the subscription

Late cancellation

Duplicate subscriptions created by the purchaser

Incorrect recipient, mailing, billing, or contact information

Mail-carrier delays

Packages marked as delivered by the mail carrier

Minor color, printing, cutting, or design variations

Digital materials that have already been delivered or accessed

6. Shipping and Delivery

Physical materials will be mailed to the shipping address associated with your subscription. Estimated mailing and delivery dates are not guaranteed. Once a package has been transferred to the mail carrier, delivery timing is outside our direct control. We are not responsible for delays caused by the mail carrier, weather, natural disasters, holidays, service interruptions, incorrect addresses, or other circumstances beyond our reasonable control. If a package arrives materially damaged or does not arrive, please contact us at iceskatingmailclub@gmail.com. Any replacement will be considered based on the circumstances and is not guaranteed. We may request photographs of damaged packaging or materials before considering a replacement.

7. Adult Supervision and Product Safety

Ice-Skating Mail Club materials are intended to be enjoyed with appropriate adult supervision.

Some packages may contain stickers, cards, paper pieces, craft supplies, or other small items that could present a choking hazard to young children. Materials are not intended for children under three years old unless specifically stated otherwise.

The purchasing adult is responsible for:

Reviewing the contents before giving them to a child

Determining whether each item is appropriate for the child’s age and abilities

Providing appropriate adult supervision

Keeping small parts and packaging away from young children

Following any instructions or safety information provided with an activity

Discontinuing use of any damaged or potentially unsafe item

Ice-Skating Mail Club materials are not toys unless specifically identified as such and should be used only for their intended purpose.

8. Allergies and Sensitivities

Colors, inks, adhesives, paper, stickers, craft materials, packaging, or other items may cause sensitivities or allergic reactions in some individuals. The purchasing adult is responsible for reviewing materials and determining whether they are appropriate for the recipient. Discontinue use immediately if irritation, an allergic reaction, or another adverse response occurs. Contact us before purchasing if you have questions about the general types of materials that may be included. We cannot guarantee that packages will be free from every possible allergen or substance.

9. Ice-Skating and Activity Disclaimer

The Ice-Skating Mail Club provides fictional stories, creative activities, encouragement, and general ice-skating-themed entertainment. Our materials do not constitute professional skating instruction, coaching, medical advice, fitness advice, or safety training. They are not a substitute for instruction from a qualified skating coach or supervision by a responsible adult. Children should not attempt skating skills, exercises, jumps, spins, or other physical activities based solely on Mail Club stories, pictures, or materials. Any on-ice activity should take place at an appropriate skating facility under suitable adult supervision and, when appropriate, with a qualified instructor. Participation in ice skating involves inherent risks. You are responsible for determining whether a child is physically able to participate and for obtaining professional guidance when needed.

10. Personal Use Only

All materials provided through the Ice-Skating Mail Club are for the personal, noncommercial use of the active subscriber, purchasing household, and intended child recipient.

You may use the materials for personal coloring, reading, collecting, display, scrapbooking, and similar household activities. Purchasing a subscription does not provide commercial, resale, reproduction, distribution, teaching, classroom, event, or group-use rights.

11. Prohibited Uses and No Resale

Ice-Skating Mail Club materials may not be resold, copied, reproduced, shared, distributed, transferred, sublicensed, uploaded, or offered as part of another product, membership, subscription, class, camp, party, website, digital download, or service.

You may not:

Sell or give away copies of the materials as standalone products

Scan, photograph, trace, or reproduce the materials for distribution

Share digital files or download links with others

Upload printable materials to another website, platform, social-media group, or file-sharing service

Use the characters, stories, artwork, cards, stickers, letters, or activities in products for sale

Use the materials for commercial classes, skating programs, camps, parties, or events without written permission

Claim our characters, designs, artwork, or written materials as your own

Remove copyright, ownership, or branding notices

Use our materials to create competing products or services

Reproduce the materials for mass or group distribution

Use any material in an unlawful, misleading, defamatory, or infringing manner

Purchasing more than one subscription does not provide resale, redistribution, commercial-use, or sublicensing rights.

12. Intellectual Property Ownership

Purchasing a subscription does not transfer ownership, copyright, trademark rights, or any other intellectual property rights to the purchaser or recipient. All Ice-Skating Mail Club characters, character names, illustrations, stories, coloring pages, trading cards, stickers, letters, activities, logos, graphics, designs, branding, and other materials remain the property of Brandy Lazar Designs and the Ice-Skating Mail Club.

Your subscription provides a limited, nonexclusive, nontransferable, and revocable license to use the materials for personal, noncommercial purposes in accordance with these Terms. No other rights are granted.

13. Photographs, Reviews, and Social-Media Sharing

You may share photographs of a child enjoying the physical Mail Club package for personal, noncommercial purposes. However, you may not post clear, complete, high-resolution images or scans that would allow another person to copy, print, reproduce, or use the materials without purchasing them. Parents and guardians are solely responsible for deciding whether to share a child’s photograph, name, artwork, or personal information publicly.

Tagging or mentioning the Ice-Skating Mail Club does not give us permission to use a child’s image in our advertising unless separate permission has been provided.

14. Third-Party Services

Our website, payment processing, shipping, email communications, or digital materials may rely on third-party platforms and service providers. Your use of those services may also be governed by their own terms, privacy policies, account requirements, and rules. We do not control and are not responsible for third-party outages, delivery failures, account restrictions, security incidents, feature changes, or discontinued services.

15. Pricing and Service Changes

We may change subscription pricing, shipping charges, package contents, included materials, or other service terms in the future. When required by law, we will provide advance notice before a price or material subscription change takes effect. Continued use of the subscription after the effective date of a properly disclosed change constitutes acceptance of the updated price or service.

You may cancel before a change takes effect by using the available cancellation method.

16. Payment Failures

If your payment method is declined, expired, or otherwise unavailable, we may attempt to process the payment again, request updated payment information, suspend shipment, or cancel the subscription. You remain responsible for authorized charges incurred before cancellation. We are not responsible for fees charged by your bank, card issuer, or payment provider.

17. Suspension or Termination

We may suspend or terminate a subscription if a subscriber or purchaser:

Violates these Terms

Shares, copies, reproduces, distributes, or resells protected materials

Engages in fraudulent, threatening, or abusive conduct

Misuses our website, materials, characters, or services

Fails to make required payments

Uses the materials in a way that could harm our business, rights, reputation, subscribers, or recipients

Violation of the personal-use, no-resale, or intellectual-property provisions may result in immediate cancellation without a refund and may lead to further action to protect our intellectual property rights. Sections concerning ownership, prohibited uses, disclaimers, liability, indemnification, and dispute resolution will survive termination.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the Ice-Skating Mail Club and all related materials are provided “as is” and “as available.”

We do not guarantee:

Delivery by a particular date

Uninterrupted website or subscription availability

Compatibility with every device or platform

That every child will enjoy every character, story, or activity

That materials will be free from minor printing, color, cutting, or packaging variations

Any particular educational, creative, athletic, or developmental result

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

19. Limitation of Liability

To the fullest extent permitted by law, the Ice-Skating Mail Club and their owners, contractors, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. This includes damages relating to lost or delayed mail, misuse of materials, allergic reactions, failure to provide appropriate supervision, or skating and physical activities undertaken by a subscriber or recipient. To the fullest extent permitted by law, our total liability arising from a claim related to the subscription, package, or materials will not exceed the amount you paid to us during the three months immediately preceding the event giving rise to the claim. Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.

20. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Ice-Skating Mail Club and their owners, contractors, and service providers from claims, losses, liabilities, damages, and reasonable expenses arising from:

Your misuse of the materials

Your violation of these Terms

Your failure to provide appropriate adult supervision

Your violation of applicable laws

Your infringement of another person’s rights

Your unauthorized reproduction, sharing, sale, or distribution of our materials

21. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be handled in a court with proper jurisdiction in Ventura County, California, unless applicable law requires a different location.

Before filing a claim, you agree to contact us and make a good-faith effort to resolve the dispute informally.

22. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on our website with a revised effective date. If a change materially affects an automatically renewing subscription, we will provide any notice required by applicable law. Your continued use of the subscription after the effective date constitutes acceptance of the updated Terms.

23. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect. The invalid provision will be interpreted or limited to the minimum extent necessary to make it enforceable where permitted by law.

24. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

25. Entire Agreement

These Terms, together with our Refund and Cancellation Policy, Privacy Policy, checkout disclosures, and other policies posted on our website, form the entire agreement between you and the Ice-Skating Mail Club concerning the subscription. If a checkout disclosure conflicts with these Terms, the disclosure that provides the subscriber with greater rights will control to the extent required by law.
